Smith Horsemanship Academy – Indemnity & Risk Acknowledgment

By accessing this website, entering the premises, or participating in any Smith Horsemanship activity, you acknowledge and agree to the terms below.

1. Definitions

“Smith Horsemanship” includes Roan Smith, Mooikrans Equus, Farm Mooigelegen, and all affiliated entities, instructors, employees, agents, and representatives.

“Activities” include all horse-related and associated activities, including but not limited to training, riding, handling, grooming, feeding, and being in the presence of animals, whether supervised or unsupervised.

“Premises” includes all areas where activities take place, including stables, arenas, paddocks, accommodation, and surrounding property.

2. Acknowledgment of Risk

You understand and accept that horse-related activities are inherently dangerous.

These risks include, but are not limited to:

  • Falling from a horse

  • Being kicked, bitten, or struck

  • Injury caused by unpredictable animal behaviour

  • Equipment failure

  • Environmental conditions (weather, terrain, fatigue)

Serious injury or death is possible.

You voluntarily accept full responsibility for all risks associated with participation.

3. Assumption of Risk

Participation in any activity and presence on the premises is entirely at your own risk.

You assume full responsibility for:

  • Bodily injury

  • Death

  • Property damage or loss

This applies regardless of cause, including negligence, third-party actions, or unforeseen events.

4. Indemnity & Release of Liability

You agree not to hold Smith Horsemanship liable for:

  • Any injury, illness, or death

  • Any loss or damage to personal property

  • Any claims arising from participation in activities

This includes claims made by:

  • Yourself

  • Your family, dependents, or representatives

  • Any third party connected to you

5. Personal Responsibility

You agree to:

  • Follow all instructions from instructors at all times

  • Act responsibly and avoid reckless behaviour

  • Participate only if you are physically and mentally fit

You confirm you are in good health and capable of participating.

6. Property & Damages

You are responsible for:

  • Any damage caused to property, facilities, or equipment

  • Any damage caused by a minor under your care

All damages must be paid upon demand.

7. Personal Belongings

Smith Horsemanship accepts no responsibility for loss, theft, or damage to personal belongings, including vehicles.

You are responsible for safeguarding your own property.

8. Environmental Risks

You acknowledge the presence of:

  • Horses and other animals

  • Insects and reptiles

  • Natural hazards

You accept all risks associated with these conditions.

9. Medical Treatment

Smith Horsemanship may, at its discretion, arrange emergency medical treatment if required.

You agree to reimburse all related costs.

10. Legal Jurisdiction

This agreement is governed by the laws of South Africa.
Any disputes will be handled exclusively within South African courts.

​

11. Severability

If any part of this agreement is found to be invalid, the remaining provisions will still apply.

​

12. No Guarantees

No guarantees or warranties are provided regarding outcomes, safety, or results.

​

13. Duration

This indemnity remains valid indefinitely from the moment you access the premises or participate in any activity.

​

14. Media Consent

You grant permission for Smith Horsemanship to use photos and videos taken during activities for marketing and promotional purposes.

​

15. Agreement

By using this website, entering the premises, or participating in any Smith Horsemanship program, you confirm that:

  • You have read and understood this indemnity

  • You accept all associated risks

  • You agree to be bound by these terms
